Terms of Service

1. Acceptance of Terms

By accessing and using 9x12 CRM ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

9x12 CRM is a customer relationship management platform designed specifically for 9x12 EDDM postcard businesses. The Service provides tools for managing campaigns, contacts, routes, invoicing, and related business operations.

3. User Accounts

3.1 Account Creation

To use our Service, you must:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Maintain the security of your password and account
• Accept all responsibility for activities under your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Free Trial

We offer a 14-day free trial period. During the trial, you have access to Basic Plan features, limited to 3 campaigns maximum. No credit card is required to start the trial. After 14 days, if you choose to continue, you will be charged $12.97/month for the Basic Plan. The Basic Plan includes access to core features, is limited to 3 campaigns maximum, includes unlimited contacts, but excludes email marketing features and team collaboration (these require the Pro plan). Pro Plan with extended features and limits is coming soon.

5. Subscription and Payment

5.1 Subscription Fees

The Service is available on a monthly subscription basis. The Basic Plan is $12.97 per month and includes access to core features, limited to 3 campaigns maximum, unlimited contacts, but excludes email marketing features and team collaboration (these require the Pro plan). The Pro Plan is $39 per month and includes unlimited campaigns, unlimited contacts, team collaboration, email marketing features, and priority support. The Pro Plan is coming soon. All fees are in U.S. dollars and are non-refundable except as required by law.

5.2 Payment

Payment will be charged to your payment method on a recurring monthly basis. You agree to:

• Provide current, complete, and accurate payment information
• Promptly update your payment information if it changes
• Authorize us to charge your payment method for the subscription fee

5.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. You will continue to have access to the Service until the end of your paid period.

6. User Content and Data

6.1 Your Content

You retain ownership of all data and content you upload or create within the Service. You grant us a limited license to use, store, and process your content solely for the purpose of providing and improving the Service.

6.2 Data Export

You may export your data at any time. Upon cancellation, you may request a copy of your data within 14 days of account termination.

6.3 Gmail Integration

If you choose to connect your Gmail account to the Service:

• You grant us permission to send emails on your behalf through your Gmail account when using our email marketing features.
• You understand that emails sent through the Service will appear to come from your Gmail account.
• You are responsible for ensuring that emails sent through the Service comply with all applicable laws, including anti-spam regulations (CAN-SPAM Act, GDPR, etc.).
• You agree not to use the Gmail integration to send spam, phishing emails, or any illegal content.
• We are not responsible for any consequences resulting from emails sent through your connected Gmail account.
• You can disconnect your Gmail account at any time, which will immediately revoke our access.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Upload or transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Copy, modify, or create derivative works of the Service
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service

8. Intellectual Property

The Service and its original content, features, and functionality are owned by 9x12 CRM and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted, error-free, or secure operation. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 9X12 CRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold harmless 9x12 CRM, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the United States.
